Hear Me LLC ("HearMe," "Company," "we," "us," or "our"), respects your privacy and is committed to protecting it through our compliance with this policy. This policy applies to the HearMe mobile application, hearme.app, and related services (collectively, the "App").

This policy describes how we collect, use, maintain, protect, and disclose your information.

This policy applies only to information we collect in this App and in email, text, and other electronic communications sent through or in connection with this App. 

This policy DOES NOT apply to information that:

  • We collect offline or on any other Company apps or websites, including websites you  may access through this App.
  • You provide to or are collected by any third party (see Third-Party Information Collection).
  • Our websites and apps, and these other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this App. By downloading, registering with, or using this App, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates. 

CHILDREN UNDER THE AGE OF 18

The App is not intended for individuals under the age of 18. We do not knowingly collect personal information from individuals under 18 years of age. If we learn that we have collected or received personal information from an individual under 18 without verified parental or legal guardian consent, we will delete that information. If you believe we may have any information from or about an individual under 18, please contact us at DataPrivacy@hearme.app .

INFORMATION WE COLLECT

We collect information in the following ways:

  • Directly from you when you provide it to us. 
  • Automatically when you use the App. 
  • From your employer or third party association, if they have paid for your subscription to the App 

Information You Provide to Us 

When you download, register with, or use this App, we may ask you to provide information: 

  • By which you may be personally identified, such as name, member or employee ID, email address, or telephone number ("personal information"). Information that is about you but does not individually identify you, such as age range, preferences, discussion topics, or lifestyle interests.

This information includes: 

  • Information that you provide by filling in forms in the App. 
  • This includes information provided at the time of registering to use the App, subscribing to our service, updating a profile and providing feedback or help and support requests. 
  • We may also ask you for information when you report a problem with the App. 
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us. 
  • Your responses to surveys that we might ask you to complete for research purposes. 
  • Your search queries on the App. 

User Contributions

You may also provide information for publication or display ("Posted") on public areas of the app or websites you access through the App (collectively, "User Contributions"). Your User Contributions are Posted and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. 

HEALTH AND WELLNESS DATA YOU CHOOSE TO SHARE

If you choose to connect Apple Health, Google Health Connect, or similar services, HearMe may collect and process certain health and wellness related information made available through those services and the permissions you grant. This may include sleep related information and associated activity information such as movement patterns, steps, and related metrics necessary to provide sleep and wellness insights. This information is used solely to provide personalized insights, wellness recommendations, improve service functionality, and enhance user experience. You may choose whether to connect these services, and you may change or revoke permissions at any time through your device settings.

HearMe does not sell health data and does not use health or wellness information for advertising purposes.

AUTOMATIC INFORMATION COLLECTION AND TRACKING 

When you download, access, and use the App, it may use technology to automatically collect: 

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access and use of the App, including traffic data, logs, communication data, and the resources that you access and use on or through the App. We do not collect precise location data. Limited regional information may be inferred by certain service providers, such as payment or subscription processors, solely for billing, fraud prevention, or compliance purposes. 
  • Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number. 
  • Location Information. This App does not collect real-time information about the location of your device. 

If you do not want us to collect this information, do not download the App or delete it from your device. 

These technologies are used to help us understand how users interact with the Services, improve functionality, analyze usage trends, enhance security, and optimize performance. They do not track users across unrelated third-party websites or for advertising purposes.

The technologies we use for automatic information collection may include: 

  • Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our App. 
  • Web Beacons. Pages of the App and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity). 

HOW WE USE YOUR INFORMATION

We may use and disclose information that we collect about you or that you provide to us, including any personal information, to: 

  • Provide you with the App and its contents, and any other information, products, or services that you request from us. 
  • Fulfill any other purpose for which you provide it. 
  • Give you notices about your account and subscription, including expiration and renewal notices. 
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection. 
  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it. 
  • Conduct mental wellness, behavioral health, and educational research using aggregated or de-identified information.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to: 

  • Estimate our audience size and usage patterns. 
  • Analyze trends, understand user needs, and improve service offerings through aggregated insights
  • Store information about your preferences, allowing us to customize our App according to your individual interests. 
  • Speed up your searches. 
  • Recognize you when you use the App. 
  • We may use the information we collect to communicate with you about updates, service announcements, new features, wellness insights, and optional promotional or marketing messages, where permitted by law and consistent with your communication preferences. 

We may also use your information to administer and support different service access levels, including free access periods, membership programs, and subscription-based features. HearMe may introduce, modify, or discontinue pricing models, membership tiers, or feature availability over time. Any material changes to how your personal information is used in connection with such changes will be communicated in accordance with this Privacy Policy.

Where required by applicable law, users may choose to opt in to specific categories of communications and may withdraw consent at any time through account settings, unsubscribe mechanisms included in communications, or by contacting us at DataPrivacy@hearme.app.

USE OF ARTIFICIAL INTELLIGENCE AND AUTOMATED PROCESSING

HearMe may use artificial intelligence, machine learning, and automated processing technologies to support platform functionality, generate insights, enhance safety monitoring, improve services, and provide personalized user experiences. These technologies may analyze user interactions, usage patterns, and aggregated information. Artificial intelligence outputs are provided for informational and wellness support purposes only and do not constitute medical, clinical, or professional advice. These technologies may also be used to analyze aggregated and de-identified interaction data to improve platform performance, enhance safety monitoring, refine artificial intelligence models, and support ongoing research and service development. HearMe does not use artificial intelligence to make automated decisions that produce legal or similarly significant effects on users. Any such analysis is conducted using aggregated or de-identified information whenever possible and is not used to make automated decisions that produce legal or similarly significant effects on users.

DISCLOSURE OF YOUR INFORMATION

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. 

We may also share de-identified, anonymized, or aggregated information with partners, researchers, and service providers for purposes such as improving platform performance, understanding usage trends, developing new features, and advancing mental wellness and sleep research. Such information does not identify individual users.

In addition, we may disclose personal information that we collect or you provide in the following circumstances:

  • To fulfill the purpose for which you provide it. 
  • For any other purpose disclosed by us when you provide the information. 
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request. 
  • To enforce our rights arising from any contracts. 
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of HearMe, our customers or others. 

We may share information with trusted service providers who support the operation and improvement of the Services. These providers may include infrastructure providers, analytics services, and platform integrations.

YOUR CHOICES ABOUT OUR COLLECTION, USE, AND DISCLOSURE 

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures over your information. 

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can choose whether or not to allow the App to collect information through other tracking technologies by clicking on the OneTrust cookie banner within the app. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly. 
  • Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some parts of the App may become inaccessible or not function properly. 
  • Promotion by the Company. If you do not want us to use your email address or other contact information to promote our own or third parties' products or services, you can opt-out. You can also always opt-out by logging into the App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to DataPrivacy@hearme.app. 

Please see the “California Privacy Rights” Section for more information. These rights apply only to residents of the State of California and are provided in addition to the global privacy rights described in this policy.

ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION 

You can review and change your personal information by logging into the App and visiting your account profile page. 

You may also send us an email at Support@hearme.app to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. 

If you delete your User Contributions from the App, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other App users. Proper access and use of information provided on the App, including User Contributions, is governed by our Terms of Use. 

California residents have additional personal information rights and choices. Please see the “California Privacy Rights” section for more information. 

LEGAL BASES FOR PROCESSING PERSONAL INFORMATION

We rely on a number of legal bases to use your personal information in the ways described herein. These legal bases include: 

• As necessary to provide our services and fulfill contractual obligations

• When you have provided consent, which you may revoke at any time

• As necessary for our legitimate business purposes

• As necessary to comply with legal obligations

• When you choose to make information publicly available

CALIFORNIA PRIVACY RIGHTS

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. European General Data Protection Regulation (GDPR) 

European Union (EU) residents and citizens are entitled to certain rights under the EU GDPR regarding our use of your personal information.

  • By contacting us through the contact information provided herein, you may have the right to access and receive a copy of the personal information associated with your account. 
  • Right to Correction 
  • You have the right to request that we correct inaccurate information about you by sending an email to DataPrivacy@hearme.app 
  • Right to Restrict Processing or Delete 
  • You may have the right to restrict or limit the ways in which we use your personal information. 
  • You may have the right to request that we delete your personal information, except for information that we are required to retain by law, regulation, or other exceptional circumstances. 
  • Right to Object 
  • If we process your information based on our legitimate interests, or in the public interest, you can object to this processing in certain circumstances. You can also object to receiving direct marketing from us by emailing us at DataPrivacy@hearme.app. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is necessary for legal reasons. 

Data Controller 

Hear Me LLC acts as the Data Controller responsible for processing personal information in accordance with applicable data protection laws.

Complaint 

If you live in the EU and wish to report a complaint, or if you feel we have not addressed your concern in a satisfactory manner, you may file a complaint with your local data protection regulator. 

RETENTION

We will retain your information for as long as is necessary to provide you with services, as long as you maintain an active account, or for the purposes set out in this Privacy Policy. However, we may also be required to retain information to comply with our legal and regulatory obligations as required by law, to resolve disputes, and to enforce our agreements. 

TRANSFERS

HearMe implements standard contractual safeguards and technical protections when transferring data internationally.

Personal information may be stored and processed in secure environments located in the United States and the European Union. When information is transferred across jurisdictions, HearMe implements appropriate safeguards consistent with applicable data protection laws, including contractual protections and security measures.

Primary processing of certain health and wellness data may occur within secure infrastructure located in the European Union.

DATA SECURITY

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology. 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the App like message boards. The information you share in public areas may be viewed by any user of the App.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide. 

CHANGES TO OUR PRIVACY POLICY 

We may update our privacy policy from time to time. If we make material changes to how we treat our users' personal information, we will post the new privacy policy on our website and notify you by email to the email address specified in your account. 

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
